ForeverMissed

This memorial website was created in memory of our loved one, David Xavier Durkin, 63, born on October 21, 1953 and died suddenly on April 27, 2017.   He will be loved, remembered and held in our hearts and minds forever.

At the Clairemont Mortuary, on Thursday, May 25, and Friday, May 26, Visitation will be from 4 pm to 8 pm with a Rosary at 6:30.  At the Holy Family Church on Saturday, May 27, his funeral Mass will be at 11 am followed by his burial at the Holy Cross Cemetery.

Born, raised and lived in San Diego, Dave passed away suddenly on April 27, 2017.  The youngest of 4 children, he attended St. Brigid’s Academy in Pacific Beach and University of San Diego High School in Linda Vista.  He went to the University of California, Berkeley for two years.  After meeting his future wife, he transferred to the University of California, San Diego, where he later graduated.  He earned his Juris Doctor at the University of San Diego.  Dave practiced law in San Diego for over 30 years.

Dave was a wonderful, loving husband and father who generously shared his time and many talents with his family,  friends and community. His compassion, kindness and companionship will be deeply missed by many and his passing is grievously mourned by both loving family and friends. Dave was the original “life is good” guy. He was a humble man with a zest for life. He was often quick to smile, laugh and share a story. Dave had a wonderful ability to find common ground with everyone and parlayed the common ground into lifelong friendships.

Dave’s law practice was modest.  He became an attorney, not as a means to become wealthy, but because it was a way for him to help his friends and contribute to his community.    His lifelong friends and family were clients and his clients were lifelong friends.

Dave leaves his wife, Lori Guardiano-Durkin and their sons, Tomas, David and Mickey; his Durkin siblings, Patrick (Janet), Michael (Dori) and Joan (Ed); his Guardiano family Lola, Tere (Don), Raymond, Peter, George and Jayme (Dean); many nieces, nephews and cousins.

Thinking of Dave today and remembering all the great birthday parties he gave. Always a wonderful gathering of interesting people of all ages. Hopefully he is gathering family and friends around him in the hereafter and someday we will be fortunate enough to know him again.

I mentioned the following in the story category, and repeat it here. I am the Price Professor of Public Interest Law at the University of San Diego School of Law.  I have had many students over the last 41 years of teaching. Dave was simply the finest, smartest and most interesting student of the thousands I have taught. He did create a problem because I have yet to find anyone among the 2,000 students who have followed him in my classes measure up to him.

Spending the past few days with all of the loving family & friends that poured out their love & many stories of Dave this past weekend helped ease the sorrow of losing Dave. We truly lost a loving man. I hope to see many more of those stories posted here so that we can read all of those wonderful joyful memories many times over the years when we are really missing him in our lives.

To Dave’s family
I am so sad to hear about your loss of Dave. I been a client of Dave for 25 years and always enjoyed our conversations about business and our families. He was very proud father and husband. He loved life and it was easy to see. I will miss Dave and our conversations. Our prayers and thoughts are with you.

We were all devastated to hear of Dave's passing. He was a friend to so many--a true man of service. Dave was one of those "all goodness and light" people; why he was taken before his time is a mystery that we will never understand. My heart goes out to Lori and their kids. We will always remember Dave with love in our hearts. --Chris Walker and Craig Carlson

Erik and I were so terribly sad to hear about Dave's passing. He was always so thoughtful, funny, and incredibly down-to-earth. We send our deepest sympathies to the entire Guardiano and Durkin families. Our thoughts are with you in this time of terrible loss. He was taken far far too soon.

Our thoughts and prayer go out to David's family members. I was lucky enough to grow up with David, his brothers and sister in Pacific Beach. I have a vivid picture in my mind of greeting David in his parents house and asking, how's it going and yes the answer was"live is good." I remember Davids interest in music and once in college his interest in political activism. It sounds like the great family David grew up in carried over to his own wonderful family. We will all miss him greatly!

When I learned of Dave's passing so suddenly, I was stopped in my tracks, hard to breathe. "Not Dave Durkin, the man so full of life, always smiling and always caring". No! I just could not understand. Such a gentle man, amazing spirit.

To Lori,Tomas, Dave and Mickey, I am deeply sorry and saddened for your loss of such a giant man, husband and father.

You are ALL in our thoughts and prayers.

i'm crushed to hear about David. Such a good man. A decent human being. And typically the smartest, most level headed person in the room. His brain was amazing, but it was his heart that looms the largest. He was always the first to be there for others, always the first with a sensible answer, always the first to find the glass that's half full, and the first to find the sweet spot where disparate people could find that what they shared far outweighed their differences. Those who knew and loved him are sad - but so filled with joy that he was part of our lives. And San Diego has lost a strong voice for fairness and justice. Lori, and your children... you are in my thoughts. We should all be so lucky as to leave the legacy your wonderful David has left. Much love. And peace.

We wish to extend our sympathy and love for David in your family's loss. We met David as client in his practice 10 years ago and saw him 4 to 5 times in his law practice for trusts and wills. His demeanor, hospitality, humanity, kindness and love of life came through to us in our interactions with him. I identified very much with him in the things that he valued in life. We will miss him very much.

So sad to hear this news, and what a shock. Dave had such an energy and love for life - I can't believe he is gone. I was lucky enough to have gotten to know him and Lori because our son went to school with their youngest, Mickey, from kindergarten through eighth grade. Dave was such a huge part of Kenny's life, and such a role model for him. Kenny and Mickey remained friends into high school and beyond, and Dave continued to be a real influence on Kenny, sharing his love of music and and always encouraging him in his educational pursuits. I have always felt that Dave contributed as much - and, in many cases, more - to our own son's success as anyone in our own family did.

So many more memories over the years - my parents also got to know Dave and Lori through the grandparent connection with Lori's mom. I'll always remember how Dad and Dave liked to talk baseball. I am so sorry for the whole family's loss. Dave was truly one of a kind, a good man, a great friend. I know that the hole left by his passing will not ever really be filled - except by the precious memories of all the love, laughter and wonderful time that you had with him.

I was shocked and saddened to hear of Dave's passing. Please accept my condolences.

I spent many enjoyable hours coaching youth baseball with Dave at North City Youth Baseball with his son, Tomas, and my sons, Kevin and Andy. Dave was a happy and funny guy, a kind and gentle man, a good father, and a fine coach. We shared many good conversations and laughs together, not only about baseball and our kids, but about life, music and especially jazz. We kept in touch over the years and I was also fortunate to work on some legal matters with Dave after youth baseball. Dave was a good lawyer, but I'll always remember him as a gentle soul and a great family man.

Always a friend in the time of greatest need

April 27, 2022
David was one of those true friends who shared his skills and wisdom whenever called upon. I remember how much he helped our friend Jeanne make her financial/legal preparations for her kids before she passed away. He gave of himself when it was really hard and left us all with a sense of relief that her kids would be OK. I’ll never forget what a truly good guy he was — miss him always

David Durkin takes down SDG&E

April 27, 2021
I was out to dinner last night with a couple of ex-execs from SDG&E who remembered that young activist lawyer who convinced the PUC to deny their $90M rate increase request. David was not only brilliant—he always stood on the side of right.  Still missing him.

A Model Law Student

January 10, 2018

I have been teaching law for 41 years and have had about 2,000 students who are now attorneys.  I am proud of a large number.  But Dave was special.  He took the classes I taught back then and his impression was indelible, as has been his work since graduation..  He was greatly interested in consumer rights and in public interest law -- two of my areas of teaching.   If I had to rank all of my former students, Dave Durkin would be at the top.  The very top.
